SB 439 (Governor’s bill sponsored by Senator Peter Wirth) puts definition of domestic partners into NM law under disguise of group health insurance.
1. SB 439 (see below) does not mandate that group health insurers provide group health insurance to domestic partners, but only if the employer of the domestic partners requests group health insurance coverage for them.
2. A similar bill was introduced in 2007 by then Rep. Peter Wirth and the 2007 FIR listed most all of the health insurance companies in NM already offering group health insurance coverage to domestic partners. The definition of domestic partners came from the group health insurance companies. (See UNM group health insurance policy for domestic partners coverage at pp. 77-78, http://www.phs.org/wcm/groups/public/@phs/@php/documents/phscontent/wcmprod1029886.pdf ).
3. Access for domestic partners to group health insurance is not an issue in NM.
4. But access is being used as cover to put the definition of domestic partners into NM law under disguise of group health insurance to show state “approval” for domestic partners.
5. SB 439 received a Do Pass 3-2 in SPAC on 2/19/09 and was to be heard in SJC today (2/28/09).
SB 439 DOMESTIC PARTNER HEALTH INSURANCE
A. An insurer that provides group health insurance pursuant to Chapter 59A, Article 22 NMSA 1978 [health insurance] [or Chapter 59A,=2 0Article 23 NMSA 1978 (group health insurance)] [or Health Maintenance Organization (HMO) Law] [or Nonprofit Health Care Plan Law] shall make available, upon an employer’s request prior to issuance, delivery or renewal, coverage for domestic partners of employees who work or are expected to work an average of at least twenty hours per week over a six-month period. Nothing in this section shall be construed to require an employer to offer or provide coverage for domestic partners of employees who work or are expected to work an average of at least twenty hours per week over a six-month period.
B. As used in this section, “domestic partners” means unmarried partners over eighteen years of age who:
(1) are in a mutually exclusive, committed relationship;
(2) have shared a primary residence for twelve or more consecutive months;
(3) are jointly responsible for the common welfare of each other; and
(4) share financial obligations.”
Thanks Bill.

In the mean time friends, please keep praying for the defeat of this legislation and pray that Gov. Richardson turns his heart to the Lord, that he gives his life to the Lord. The Gov. is still wanting to go against the will of the people. He is very upset ii the defeat in the Senate. He will not let go.
We are the people of God’s kingdom. Our prayers move God to change the world. We may not completely understand the mystery of prayer, but we don’t need to. This much is clear…….Actions in heaven begin when we pray here on earth. What an amazing thought!
When we speak, Jesus hears.
And when Jesus hears, thunder falls.
And when thunder falls, the world is changed…………hearts are changed.
All because we prayed.
Prepare your fields for RAIN!
It has already started to RAIN!!!
God Bless you all, Dewey Sharon and Family
